Law 5302/2026 for the Establishment of an Innovation Fund, Patient Access to New Medicines and Treatments, Improvement of Health Services and Other Provisions

On May 15, 2026, Law 5302/2026 (Government Gazette Α’ 78/20.05.2026) was adopted, aiming, among else, to improve patient access to innovative medicinal products and treatments, strengthen the operational framework of the National Organisation for Health Care Services (“EOPYY”), ensure adequate market coverage, enhance transparency in the distribution and reimbursement of medicinal products and upgrade the overall quality of the national healthcare system.

Key elements of Law 5302/2026 include:

  • Establishment of an Innovation Fund as a distinct category of pharmaceutical expenditure for innovative medicinal products.
  • Introduction of AI tools to support the operation and decision-making of EOPYY.
  • Expansion of the scope of the Electronic Pre-Authorisation System to additional categories of medicinal products.
  • Prioritisation of stocks of emergency-imported medicinal products in cases of suspension of distribution or shortage of supply.
  • Free distribution of certain ‘slow-moving’ medicinal products that are emergency-imported by the Institute of Pharmaceutical Research & Technology S.A.
  • Restrictions concerning the sale, offer and distribution of tobacco and nicotine products to minors.
  • Prohibition of the retail sale, distribution, supply, purchase and use of dried cannabis flower derived from varieties of the Cannabis Sativa L. species with a THC content of up to 0.3%
