With the adoption of the Law on Special Conditions for the Recording and Registration of Property Rights (commonly referred to as “On One’s Own Land”), the state has opened up the possibility for owners of illegally constructed buildings to finally obtain legal ownership status and register their property rights through a significantly simplified procedure.
What “On One’s Own Land” means for property owners
- Registration is possible even where a building has been constructed illegally, including cases in which no building permit or technical inspection was obtained;
- The procedure is digitalised: applications are primarily submitted via a digital platform, while traditional submission at the municipality or by post remains available;
- In addition to personal details, information relating to the property is required (cadastral parcel or address, building ID or map designation, type and total floor area of the building, number of storeys), as well as proof of acquisition of the property (e.g. contract, inheritance, court decision);
- A prerequisite is that the building is not located in an area subject to legal restrictions (protected zones, land owned by another person, expropriation, or similar limitations).
Why it is important to carry out legalisation properly
- The registration of ownership rights provides legal and commercial certainty. Once registered, the property acquires real market value and may be lawfully transferred, sold, used as collateral, or otherwise commercially exploited;
- If an application is not submitted within the prescribed deadline, or is not supported by appropriate documentation, there is a risk that the state may register ownership rights in its own favour, or that the competent authority may order the removal of the building;
- Errors in documentation, unclear or incomplete information, or a lack of proof of ownership rights to the associated land may result in the rejection of the application or lead to subsequent legal issues (such as disputes, incorrect registrations, and similar complications).
How we can assist you
As a law firm with experience in property law, we provide comprehensive legal support throughout the entire process:
- We review whether you are in possession of all required documentation;
- We assist with the submission of the application for the registration of an illegal building via the “On One’s Own Land” digital platform;
- We monitor the procedure and address any deficiencies, initiating additional actions where necessary (e.g. providing proof of ownership of the property or the land);
- We ensure that ownership rights are properly registered in the cadastre, thereby securing a clear legal status for the property and protecting your interests in the event of a future sale, transfer, inheritance, or mortgage.
“On One’s Own Land” represents a unique opportunity to legalise a building through a relatively simplified procedure and to align its legal status with the actual situation. However, for the process to proceed smoothly, it is essential that the application is both legally and formally compliant.
Applications for legalisation may be submitted from 8 December 2025 and within a period of 60 days thereafter. If you wish to avoid uncertainty and unnecessary risks, and to ensure that your property is properly legalised, you may contact us for legal assistance and a detailed review of the documentation in your possession.
